Emefiele: Court Strikes Out DSS Application for Detainment

A Federal High Court in Abuja has struck out an application filed by the Department of State Services (DSS) for an order to detain the suspended Governor of the Central Bank of Nigeria, Godwin Emefiele for additional 14 days.

The security agency informed the Court that fresh evidence has been uncovered that further warranted the request for the order. However, the vacation judge, Justice Hamza Muazu questioned his Court’s jurisdiction to handle the matter, in view of sections 293 and 296 of the Administration of criminal Justice act which vested exclusive rights on the Magistrate court to grant detention orders.

With this development, DSS counsel Victor Ejelonu having withdrawn the application, the Court proceeded to strike it out. Emefiele was re-arrested in Lagos, after his arraingment before a Federal High Court Lagos, on a two-count charge.
